Terms of Service

1. Acceptance of terms

By using elderntomes.com (the “Site”) or placing an order, you agree to these Terms of Service (“Terms”). If you don't agree, please don't use the Site. We may update these Terms from time to time; the “Last updated” date at the top reflects the current version. Continued use of the Site after an update constitutes acceptance of the revised Terms.

2. Who we are

Ældern Tomes is a collectible bookstore operated as a sole proprietorship in Columbus, Ohio (“we”, “us”, “our”). All business correspondence should be directed to contact@elderntomes.com.

3. Product listings & accuracy

Every book in our inventory is a one-of-a-kind used or collectible item. We make good-faith efforts to photograph and describe each item accurately, including condition flaws (foxing, bumps, ex-library marks, dust jacket wear, etc.). Listing photos are the source of truth for condition. Minor variations between the photos and the actual book's appearance on your device (color calibration, lighting) are not grounds for a return.

We reserve the right to correct errors, update listings, and cancel or refuse any order — including, but not limited to, orders where the product was mispriced or inventory was incorrect. If we cancel your order, you'll receive a full refund.

4. Pricing & payment

• All prices are listed in U.S. dollars.
• Payment is processed by Stripe. We don't receive or store your full card details.
• You are responsible for any applicable state or local sales tax collected at checkout.
• Prices may change at any time. Once an order is placed, the price at purchase is locked in for that order.

5. Orders & shipping

Orders are fulfilled per our Shipping Policy. Returns and refunds are handled per our Returns & Refunds policy. Both policies are incorporated into these Terms by reference.

6. Intellectual property

The Site, its design, and original written content (including blog posts and listing descriptions) are © Ældern Tomes. You may not copy, republish, or redistribute Site content without prior written permission. Book cover images and author content remain the property of their respective rights holders.

7. Acceptable use

When using the Site, you agree not to:

• Use the Site for any unlawful purpose.
• Scrape, harvest, or automate access to product listings or pricing data without prior written permission.
• Attempt to disrupt, reverse-engineer, or circumvent the Site's security.
• Submit fraudulent orders or use stolen payment credentials.
• Impersonate another person or misrepresent your affiliation with anyone.

We may suspend or cancel accounts and orders that violate these terms.

8. Disclaimers

The Site and our products are provided “as is” and “as available” to the fullest extent permitted by law. We make no warranties — express or implied — beyond the condition described in each listing. This includes no warranty of merchantability, fitness for a particular purpose, or non-infringement, except where such disclaimers are prohibited by applicable law.

9. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Site or an order is limited to the purchase price of the item(s) at issue. We are not liable for indirect, incidental, consequential, or punitive damages (including lost profits, lost data, or emotional distress), even if we've been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold Ældern Tomes harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site or violation of these Terms.

11. Governing law & disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved in the state or federal courts located in Franklin County, Ohio, and you consent to the jurisdiction and venue of those courts.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
